Anger is Brewing is on track for a fast and furious ACTION packed rest of 2008. We have our work cut out for us!
The Nevada Legislature report cards are almost complete. NV Assembly and Senate members are rated on a GOOD/BAD scale for 15 different votes (more added later) on three different factors: Accountability, Fiscal Responsibility, and Transparency. The political affiliations of legislators are not included in their report cards, the results are independent of the letter behind their names.
One of the things that became abundantly clear during the collection of information is that the “RECALL” process has been underutilized in the state of Nevada. Please click HERE to download the Nevada Recall Guide from the Secretary of State website.
In addition to the candidates report cards, we will be publishing a list of candidates by Senate and Assembly districts, including Federal offices, with links to additional information, volunteer links, and donation links.

HR 2454, whether you believe global warming to be human caused or not, is the single most damaging piece of legislation we’ve seen come out of Washington, DC ever. It cures nothing, solves nothing, and bares our economic throat to the entire world so they can prosper without competition from the US and without the burden of environmental regulations abroad.

On 03/09/2009 a 98-page report on climate change was produced by the Environmental Protection Agency (EPA). This is the most comprehensive and up-to-date report by the EPA on climate change. Author – Alan Carlin (38 years with the EPA, B.S. – Physics from California Institute of California (Cal Tech), PhD. Economics – Massachusetts Institute of Technology (MIT).
1.2 Global Temperatures Have Declined Significantly
Global temperatures have declined (Figure 1a) – extending the current run of time with a statistically robust lack of global temperature rise to eight years (Figure 1b), with some people arguing that it can be traced back for 12 years (Figure 1c). This report has been ignored by our political representatives; it has been suppressed and is not on the EPA website any longer. The whole premise of the legislation is a hoax and a fraud that would cost all Americans $Trillions and millions of jobs.

- In April, the Polish Academy of Sciences published a document challenging man-made global warming….Dr. Kiminori Itoh, a Japanese environmental physical chemist who contributed to a U.N. climate report, dubs man-made warming “the worst scientific scandal in history.” Norway’s Ivar Giaever, Nobel Prize winner for physics, decries it as the “new religion.”

The Analysis
- A similar scheme has been implemented in Europe and has been an abysmal failure.

- The Charles River Associates, a Harvard based economics consulting firm, estimates a net loss of jobs from the bill of about 2.5 million each year. Click HERE for the CRA report.
This is being proposed while we are having the fastest job losses and highest unemployment in at least 26 years…so far.

CEI (Competitive Enterprise Institute) released a memo, written by the presidential transition team 11/06/2008, “economic costs will likely be on the order of 1 percent of GDP, making them equal in scale to all existing environmental regulation.”
- The CEI (Competitive Enterprise Institute) obtained a memo from the U.S. Treasury Department (Dated 03/09/2009) through a Freedom of Information Act request (the memo removed from the website), and said: “The Obama administration has privately concluded that a cap and trade law would cost American taxpayers up to $200 billion a year, the equivalent of hiking personal income taxes by about 15 percent.” They added: “At the upper end of the administration’s estimate, the cost per American household would be an extra $1,761 a year.”
- 305 Million people / $141.43 Billion Annual Carbon Tax (1% of GDP) = 463.70 per person per year or $1,854 per year ($154.50 per month) for a household of Four.
- Mr. Obama and Mr. Waxman (Bill sponsor) having access to the above reports have repeatedly stated that it would cost “approximately the cost of a postage stamp per day” $.43 X 365 = $156.95 per year, understated by 1181%.
Now, China and many other nations will be very happy to accept businesses leaving America and filling our lost jobs with their own citizens, due to higher energy costs for everything in this country. They will increase global CO2 emissions more than we reduce them because those countries are less energy efficient than we are. Some companies will close in America, sell their CO2 credits and set up in China, India, and Vietnam, etc. What a gift we are giving the rest of the world. Fifty-two percent of our electricity is produced by “dirty coal.” We import over 70% of our liquid fossil fuels (from several unfriendly and unstable countries, i.e., Nigeria, Venezuela and Mexico (unprecedented production decline)). Ninety seven (97%) of our transportation system depends on liquid fossil fuels. Airplanes, ships, trains, large trucks, agricultural and mining equipment do not run on solar panels (only when there is sunlight), wind turbines (only when there is wind), geothermal, tides, biomass, hydroelectric or nuclear power. There is no short term alternative and we have no viable “Plan B.” One million electric cars (that don’t exist} is less that 0.5% of the estimated 220 million car fleet in the U.S. The average rate of turn over of our vehicle fleet is less than 5% per year, taking 22 years to convert our entire vehicle fleet if not one more new conventional fuel car is ever sold again – delusional. How long will it take and how much will it cost to replace 150 years of “dirty coal” burning power plants (49% of total electrical generation)? Our Energy Policy is an impending disaster with a Capital “D,”.
We will have climate change. It has happened over the entire history of the earth, with and without mankind.
The deceit, treachery and lying (not misinformation, disinformation or untruth) done to impose this on the American public is an OUTRAGE!! This is not an honest mistake. The whole premise is a lie and there are 1,428 pages of cryptic, hidden, buried and undesirable provisions in there. The prima facie case is that the whole premise is a deliberate lie and therefore none of its contents can be trusted…..again!

The Obama Administration has FINALLY acknowledged the devastating impact the Cap and Trade legislation (narrowly passed in the House) would have on American families.
“The Obama administration has privately concluded that a cap and trade law would cost American taxpayers up to $200 billion a year, the equivalent of hiking personal income taxes by about 15 percent.”
A better idea.
The American Society of Civil Engineers (ASCE) has given the U.S. an overall “D” grade in 15 categories of infrastructure and we need to spend $2.2 trillion over the next 5 years or have more (broken power line in Ohio causing a 55 million person blackout) catastrophic levee failures like New Orleans and the Midwest last year, the bridge failure in Minneapolis in 2007-an urgent and immediate need providing real jobs for many already skilled and qualified Americans.

Pants on Fire

Senator Harry Reid is proud of his relationship with Nevadans and pleased to announce that he’s spoken to us and we agree with him:
“I spent the month of August in our state, talking about the importance of health insurance reform and debunking some of the myths that opponents have spread. The majority of Nevadans stand in favor of real reform, because they know the costs of inaction are too high… ”
~Reid Report, September 9th.
In fact, Senator Reid was happy to talk ‘to’ supporters, the rest of us got talked ‘at’, if that.
Let’s say, for one moment, that Senator Harry Reid is not a pathological, self serving, power hungry, narcissist pushing projects through for personal profit and sacrificing taxpayers on the alter of special interest while pandering to certain demographics for the purpose of purchasing votes for future, all to ensure he can continue his reign as the king of the unfunded mandate. Yes, let’s say for now that none of that applies.
At best, he’s completely out of touch with those of us that have tried to have conversations with him about the actual contents of HR 3200.
Harry says:He is working tirelessly to bring both sides of the aisle together and is hopeful that a quality, comprehensive, bi-partisan bill is within reach.
Bonus points to the reader who knows the actual number of bills and amendments submitted by Republicans that Senator Reid has turned his back on… At last count it was 19.
The fact is, we’re not opposed to reform, but in the form of free market competition. Lift portability restrictions, let us decide what we’ll pay for and how much, what we need and what we don’t, what we want and where to buy it. Competition inspires innovation and everybody wins.
You know what would be great? If the government spent as much time trying to inspire self-reliance, individual responsibility, accountability, and personal pride instead of a government system of reliance and dependence. The easy transition from having your hand out to putting your fist in the air is directly responsible for the lack of dialog and coordinated effort to “fix” a system that the government itself created.

Federally Funded Fraud vs. the RICO Act of 1970

Last week, we received confirmation that the US House and Senate
House Votes to Defund ACORN Washington, Sep 17 -
Republican Study Committee Chairman Tom Price (R-GA) issued the following statement after the House of Representatives voted to prohibit federal funding to ACORN by a vote of 345-75.
“An overwhelming bipartisan majority of the House took an important step in the right direction by voting to prohibit this organization from receiving any federal assistance,” said Chairman Price. “It’s a travesty that taxpayer money was ever allowed to fund ACORN’s fraud and corruption. It has long been understood that ACORN’s continued federal funding is only a result of its alliance with congressional liberals. We must diligently make certain that Democrats keep their new promise to block tax dollars for this group. And as we must see how far this corruption goes, I urge Democrat leaders to call hearings on this matter and call on the Administration to conduct a full audit so the American people may learn the full truth and get their money back.”

WASHINGTON (AP) — The Senate voted Monday to block the Housing and Urban Development Department from giving grants to ACORN, a community organization under fire in several voter-registration fraud cases.
The 83-7 vote would deny housing and community grant funding to ACORN.

While this is good news, there is no guarantee that federal investigations of corruption will go forward.

Is ACORN Intentionally Structured As a Criminal Enterprise?

In 1970, Congress passed the Racketeer Influenced and Corrupt Organizations (RICO) Act, Title 18, United States Code, Sections 1961-1968. At the time, Congress’ goal was to eliminate the ill-affects of organized crime on the nation’s economy. To put it bluntly, RICO was intended to destroy the Mafia.
Throughout the 1970’s, RICO’s intended purpose and its actual use ran parallel to each other. Seldom was RICO used outside of the context of the Mafia, and it is not an overstatement to say that civil claims under RICO were simply not brought.
In the 1980’s, however, civil lawyers noticed section 1964(c) of the RICO Act, which allows civil claims to be brought by any person injured in their business or property by reason of a RICO violation. Any person who succeeded in establishing a civil RICO claim would automatically receive judgment in the amount of three times their actual damages and would be awarded their costs and attorneys’ fees. The financial windfall available under RICO inspired the creativity of lawyers across the nation, and by the late 1980’s, RICO was a (if not the most) commonly asserted claim in federal court. Everyone was trying to depict civil claims, such as common law fraud, product defect, and breach of contract as criminal wrongdoing, which would in turn enable the filing of a civil RICO action.
RICO’s broad application was the result of Congress’ inclusion of mail and wire fraud as two crimes upon which a RICO claim could be brought. Given the breadth of activities that had historically been criminally prosecuted under the mail and wire fraud statutes, it was not difficult for creative civil attorneys to depict practically any wrongdoing as mail or wire fraud.
During the 1990’s, the federal courts, guided by the United States Supreme Court, engaged in a concerted effort to limit the scope of RICO in the civil context. As a result of this effort, civil litigants must jump many hurdles and avoid many pitfalls before they can expect the financial windfall available under RICO, and RICO has become one of the most complicated and unpredictable areas of the law.
Today, RICO is almost never applied to the Mafia. Instead, it is applied to individuals, businesses, political protest groups, and terrorist organizations. In short, a RICO claim can arise in almost any context.

The following article is from the Buckeye Institute and outlines a lawsuit filed in Warren County, OH , in October of 2008, against ACORN under the Ohio Corruption act. For full complaint, click HERE.
The Buckeye Institute, a Columbus-based think tank, today filed a state RICO action against the Association of Community Organizations for Reform Now (ACORN) on behalf of two Warren County voters. The action filed in Warren County Court of Common Pleas alleges ACORN has engaged in a pattern of corrupt activity that amounts to organized crime. It seeks ACORN’s dissolution as a legal entity, the revocation of any licenses in Ohio, and an injunction against fraudulent voter registration and other illegal activities.
Plaintiffs Jennifer Miller of Mason, Ohio and Kimberly Grant of Loveland, allege that ACORN’s actions deprive them of the right to participate in an honest and effective elections process. They allege fraudulent voter registrations submitted by ACORN dilute the votes of legally registered voters.
“The right to cast a vote that is not diluted by fraudulent votes is a fundamental individual right,” Buckeye Institute President David Hansen said.
“ACORN appears to be recklessly disregarding Ohio laws and adding thousands of fraudulent voters to the state’s roles in the process,” Maurice Thompson, Director of the Buckeye Institute’s 1851 Center for Constitutional Law said. “Such voter fraud erodes the value of legally cast votes,” he added.
In the complaint, Thompson cites an accumulation of evidence showing numerous instances of admitted fraud by ACORN employees, as well as individuals solicited by ACORN.
“In light of its hiring, training and compensation practices, ACORN should have known its conduct would cause fraud,” Thompson said. “It also should know that its conduct will cause fraud in the future.”
In addition, the complaint cites conduct by ACORN in Colorado, Indiana, Louisiana, Michigan, Missouri, Nevada, New Mexico, North Carolina, Pennsylvania, Texas, Virginia, Washington and Wisconsin.

| HR 1207: Federal Reserve Transparency Act

Right now, the House Financial Services Committee is holding a hearing on H.R. 1207, the Federal Reserve Transparency Act, which authorizes a comprehensive audit on the Federal Reserve.

1. It is imperative that we remind those on the House Financial Services Committee not just to support an audit of the Fed, but to vote on this bill on its own merits, without modifying it and without attaching it to other legislation.

Talking Points:
The Federal Reserve was created by Congress in 1913 and thus it is their responsibility to ensure it is meeting its Congressional mandates effectively, efficiently, lawfully.
Among its mandates is to furnish the country with a flexible currency, that expands and contracts in accordance with the economy. The Fed’s loose monetary policies have led to a 95% devaluation on the dollar.
The Federal Reserve is not independent of politics given that the Federal Reserve Board is nominated by the President and confirmed by the Senate for a 6-year period. The Federal Reserve Chairman is also appointed by the President and confirmed by the Senate for a 4-year period. Therefore, political pressure exists for the Board to keep interest rates low so as to secure reappointment from federally elected officials.
During the current economic crisis, Congress, the Treasury, and the Fed have put us on the hook for over $12 trillion in bailouts and loans. This is in addition to our almost $12 trillion national debt. When testifying before Congress, Fed Chairman Ben Bernanke has refused to disclose which institutions have received trillions of dollars in these bailouts and loans or to give our representatives details about what deals are being made with foreign banks.
The Fed’s current audits do not include review over monetary policies. Title 31, Section 714 restrains the Government Accountability Office from auditing the Fed’s monetary policy transactions, deliberations or communications. |
